Family law can be extremely emotive when marital disharmony spills into law firms and ultimately court room. An intelligent but realistic approach is needed but is often lost in this area of law.

Distributing the family assets is a basic concern. It has been described by Family Court judge as an art form which can be beyond the understanding of lay person. The Family Law Act has provisions on how assets should be distributed. The issue is how to apply those clauses. Realistic expectation and demands are key to successful negotiation and obtaining the necessary judgment from Court.

Parenting orders are another common area of dispute. Shared parenting is the aim unless there is exceptions such as family violence. Parenting arrangement is both a matter of common sense and legal inputs in order to make it work.

There are also cost effective means of preventing or dealing with family dispute including use of pre-nuptial agreement, consent orders, financial agreement, etc. The key is being rational and informed of the legal issues and try to work out a solution effectively within the shadow of the law.
